TAMTAM HACKATHON RULES

1. PRESENTATION OF THE TAMTAM DIGITAL SCHOOL

TamTam Digital School, a school of higher education, with headquarters in Agoè in the city of Lomé, TOGO (hereinafter referred to as the “Organizer”) organizes a free Hackathon-competition called “TamTam Hackathon” (hereinafter referred to as the “Hackathon”). GOOGLE USA, headquartered in the United States, provides assistance in terms of technical mentoring sessions in development to TamTam Digital School in the organization of the Hackathon (hereinafter referred to as the “Partner”). The Hackathon Final will take place November 24th-25th, 2020.

2. PURPOSE OF THE HACKATHON

The Hackathon, a contraction of “hack” and “marathon”, aims to allow people with a variety of skills to create innovative digital projects on an imposed theme, during 24 hours, and to win a prize at the end of the Hackathon.

3. CONDITIONS OF PARTICIPATION

Each Participant (hereinafter referred to as the “Participant”) must meet the following conditions : 

3.1. The Hackathon is accessible to all developers, web designers, marketers and communicators. 

3.2 The Hackathon is open to any individual 20 years of age or older.

3.3. By registering, the Participant expressly accepts all the clauses of these rules. 

3.4. Only one participation per person is allowed.

4. HACKATHON ANNOUNCEMENT

It will be announced in particular on the following websites (hereinafter referred to as the “Website”: www.tamtam.com; on social networks and on any other medium at the choice of the Organizer and its Partner.

5. REGISTRATION AND PARTICIPATION TERMS AND CONDITIONS

5.1. Registrations are made by filling out the online form available at https://tamtamdigital.org/events/.

Registrations are free of charge and open according to the schedule in Article 6.1. Registrations are limited to 100 Participants within the limit of available places per skill set proposed in Article 3.1. Beyond these quotas, registration requests will be placed on a waiting list. No registrations will be considered after the registration deadline. The Organizer reserves the right to modify these dates. Participants will be informed of any changes on the websites. 

5.2. Following this registration, Participants receive either a confirmation of registration by e-mail within the limit of available places per proposed skill, or a confirmation of registration on the waiting list. For persons who do not have one of the proposed skills, their registration will be validated or not after study of their application following an additional request for information which will be made by e-mail by the Organizer or its Partner. 

5.3. The Participants undertake to provide complete and accurate information. The Organizer reserves the right to request supporting documents for each of the Participants’ declarations. Any Participant having given incomplete and/or inaccurate information will have his participation in the Hackathon invalidated, without possibility of dispute. Any false identity or address information, or non-compliant document may invalidate the Participant’s participation and the cancellation of any winnings. The Organizer reserves the right to refuse any registration application that is incomplete and/or does not meet its expectations. The Organizer can in no way be held responsible for entries not received or registered too late. 

5.4. Participants whose registration is confirmed by the Organizer or its Partner and who attend the Hackathon until its end are automatically assigned a participation number.

6. PRINCIPLES AND RUNNING OF THE HACKATHON

6.1. Place and calendar 

The Hackathon takes place according to the following calendar: 

Launch : 01st october

Registration an ideation: 01 to 22 October 2020

Preselection vote: October 23 to 28

Deepening: 29 Oct to 09 November

Selection 10 November to 15 November

Mentoring: November 16 to 22

Final : November 24th to 25th

Deliberation: November 26th to November 30th

Publication of the winners’ names: 01 December

Award Ceremony: December 04, 2020 

The calendar and the course of the Hackathon are given as an indication and may be subject to changes decided by the Organizer. 

6.2. Each Participant participates in the Hackathon with his own equipment (computers and software). The Hackathon takes place entirely online. Participants remain solely responsible for their equipment throughout the Hackathon.

6.3. Participants will present themselves individually. At the start of the Hackathon, Participants may or may not form teams. Each Participant is free to join the team of his choice, within the limit of three (03) Participants per team, the Organizer’s liability cannot be engaged in this respect. 

6.4 Each team must designate a member in charge of relations with the Organizer, called the “Referrer”. The physical presence of at least one Participant per team at all times at the Hackathon venue is mandatory. 

6.5. Projects of the Participants : Each team shall provide through Google Slide, as defined in the above schedule, a presentation (hereinafter the “Project”). The presentation will be written and made in French language.

7. SELECTION OF WINNERS

7.1. Hackathon 

7.1.1. Composition of the Competition Jury 

The jury is made up of the Organizer (hereinafter the “Jury”). It includes personalities chosen by the Organizer.

7.1.2. Designation of the winners of the Contest – Sovereignty of the Jury 

The members of the Jury will have evaluation criteria that will allow them to judge the Projects. As an indication and without this list being exhaustive, the criteria will be: creativity, ergonomics, innovative character, graphic qualities, accessibility, technical feasibility, taking into account the economic dimensions of the Project. The Participants acknowledge that the Jury is sovereign and does not have to motivate its decisions. The Participant expressly undertakes not to contest the composition, the decision-making method or the decision of the Jury. The winners of the Hackathon will be designated immediately after the Jury’s deliberation.

7. SELECTION OF WINNERS

7.1. Hackathon

8. DOTATIONS

8.1. The winners of the Contest, designated by the Jury in accordance with section 7.1 of these rules, will be awarded the following prizes:

 – 1 st prize:The winner of the competition will win an Apple MacBook and technical development mentoring sessions with Google Developers from Google USA.

 -2 nd prize: The second winner will receive a 50% scholarship for the first year and a 25% scholarship for the second year in the software development and user interface program at TamTam Digital School.

3rd prize: The third winner will receive a 25% scholarship for the first year only at TamTam Digital School.

8.2. The prizes will be awarded according to the schedule specified in article 6.1. 

The Participants must therefore be on site at the time the prizes are awarded. Prizes will be accepted as announced and are not transferable. The prizes offered may not give rise to any dispute of any kind on the part of the Participants, nor to the payment of their cash equivalent, nor to their replacement or exchange for any reason whatsoever. The winners authorize all verifications concerning their identity and the conformity of the information communicated at the time of their registration. 

Prizes unclaimed/withdrawn under the conditions referred to in these rules will not be given in Hackathon, the Organizer may freely dispose of them. In case of force maHackathonre, or if circumstances require it, the Organizer reserves the right to replace the prizes won by prizes of equivalent or higher value. 

8.4. The Organizer may, without it being an obligation, propose to the teams, winners or not of the Contest, to take part in the financing and the development of their Project, according to conditions to be defined within the framework of a later agreement in the respect of the present terms and conditions.

9. PERSONAL DATA

When transmitting the information necessary for the Participant’s registration to the Organizer and its Partner, the Participant communicates to the Organizer and its Partner his or her last name, first name, skills, postal address, cell phone number, e-mail address and, if applicable, Twitter or Facebook account. These personal data are collected and processed by the Organizer and the Partner for the purposes of management and organization of the Hackathon. The Participant has the right to access, modify, rectify, delete and oppose the personal data concerning him/her. 

To exercise one of these rights, it is his responsibility to send an email indicating his first and last name.

10. IMAGE RIGHTS AND AUTHORIZATIONS

10.1. The Participant authorizes the Organizer and its Partner, free of charge, to use his name and / or first name and the description of his Project in any event for advertising or promotion related to the Hackathon and in particular on the Sites and websites of the Organizer and Partner, in all press releases and articles, advertising documents or commercial brochures, by any means and any media, for a period of five (5) years from registration to the Hackathon, worldwide. 

10.2. The Participant authorizes the Organizer and the Partner, free of charge, to publish all photographs, images and videos taken during the Hackathon on all media, in all formats and by all methods and processes known or unknown to date, for a period of five (5) years from registration to the Hackathon, for the entire world. 

10.3. The Participant authorizes the Organizer and the Partner, free of charge, to exploit any audiovisual and/or sound recording taken during the Hackathon (image and sound or image or sound separately, in extracts and/or in full), on all media, in all formats and by all methods and processes known or unknown to date, for a period of five (5) years from registration to the Hackathon, for the entire world. 

10.4. The Organizer shall obligatorily mention the name and surname of each Participant in the Project when it is used for media purposes. 

10.5. The Participants can benefit from a communication of the Projects they are carrying through media actions initiated by the Organizer and/or the Partner. The Participants shall make their best efforts, during the year following the date of the awarding of the prizes, to respond to the Organizer’s requests with the aim of promoting the Participant’s Project. 

10.6 In the year following the date of the awarding of the prizes, the Participants are required to propose to the Organizer, as a priority, any collaborations that they may wish to carry out with third parties in connection with the Project. In the event that the Organizer expressly notifies the Participants in writing that they are not interested in the proposed collaboration, the Participants become free to begin discussions with third parties to begin collaboration on the Project.

11 .INTELLECTUAL PROPERTY RIGHTS

11.1. Intellectual property rights on the Hackathon and its elements 

11.1.1. All names, trademarks or other distinctive signs cited in these rules or on the pages of the Sites remain the exclusive property of the Organizer. The reproduction and representation of all or part of the elements composing the Hackathon are strictly prohibited. 

11.1.2. All data (including photographs and text) made available to Participants during the Hackathon by the Organizer and/or Partner (hereinafter the “Data”) remain the exclusive property of the Organizer and/or Partner. The Participants undertake to use the Data in such a way that it remains divisible from the rest of the Project and is not governed by one or more open licenses. Absolutely, the right of the authors of the Data is reserved and the Participants may only use the Data in strict compliance with this right. The authorization for the Participants to use the Data as made available by the Organizer and/or the Partners or in a derived form is limited to the duration of the Hackathon as specified in article 6.1 of the present rules. For any use of the Data outside the framework of the Hackathon, a new contract must imperatively be concluded between the Participant and the Organizer and/or the Partner. 

11.2. Intellectual property rights on the Projects 

11.2.1. Participants do not assign in any other way and to any other party their rights to operate and own their Project. However, Participants may propose to the Organizer to acquire the rights for commercial exploitation. The parties must formalize this assignment in writing. However, for the duration of the Hackathon, the Participants grant, without financial consideration, a right to use their intellectual property rights to the other Participants when they are necessary for the execution of the Projects and for the sole purpose of such execution. 

11.2.2. All Projects provided by the Participants during the Hackathon must be personal creations. The Participants must use only royalty-free sources and content. Such use shall be under their sole responsibility. Any third party materials, including open source software, must be clearly identified with their version, the applicable licensing terms and any other details regarding their use. The Participant understands that this information is taken into account in the evaluation for the price. Under no circumstances shall the creations infringe any intellectual property right or image right. Each Participant guarantees to the Organizer that his or her creation does not in any way affect any rights that may be held by a third party, and that he or she has obtained, where applicable, the authorization of third parties who may have participated in its development. The Participant acknowledges being informed that he or she will be held solely responsible in the event of inaccuracy of this declaration and violation of his or her obligation of guarantee, the Organizer and the Hackathon Partners being guaranteed against any recourse by any third party in this respect.

12. COMMITMENTS, RESPONSIBILITY AND GUARANTEES OF THE PARTICIPANTS

12.1. The Hackathon must remain a friendly and ethical event. The Participant undertakes to respect these principles and acknowledges in particular that any action aimed at hindering the progress of other teams is not authorized. The Organizer reserves the right or faculty to disqualify, exclude from participation in the Hackathon or not to award prizes to any team or Participant who does not respect these principles. The same applies to a Participant who has defrauded, rigged or disrupted the Hackathon or has attempted to do so. Any person attempting to cheat, slow down, deteriorate the Sites and any other Internet site of the Organizer will be exposed to legal proceedings. 

12.2. The Participant declares that he or she has, without restriction or reservation, the rights set forth herein and the capacity to commit himself or herself. The Participant is solely responsible for the content of the elements developed and transmitted as part of the Hackathon and declares that they comply with the legislation in force, particularly with regard to the intellectual property rights of third parties. 

13. COMMITMENTS AND GUARANTEES OF THE ORGANIZER AND/OR PARTNERS

The responsibility of the Organizer could not be incurred if, for a case of force or independent of its will, and in particular in the event of insufficient participations, the Hackathon was modified, shortened, lengthened, postponed or cancelled. It reserves in all cases the right to extend the period of participation and to postpone any announced date. In any case, if the smooth administrative and / or technical running of the Hackathon is disrupted by a virus, computer bug, anomaly, technical failure, unauthorized human intervention or any other cause beyond the control of the Organizer, the Organizer reserves the right to interrupt the Hackathon. The Organizer does not provide any service or guarantee other than the provision of the prizes provided for in Article 8 of these rules. 

The Organizer shall not be held liable in the event of poor reception or non-receipt of entries by electronic means for any reason whatsoever. The Organizer cannot therefore be held responsible if the data relating to the registration of a Participant does not reach him or arrives illegible or impossible to process. The Organizer reminds the Participants of the characteristics and limits of the Internet network and declines all responsibility for any consequences that may arise from the connection of the Participants to this network via the website at the time of registration or via the Participants’ wifi Internet connection during the Hackathon. 

 The Organizer declines all responsibility in case of misuse or incident related to Internet access, maintenance or malfunction of the Hackathon servers, telephone line or any other technical connection and the sending of registration forms to an incorrect or incomplete address. The participation of Participants in the Hackathon is under their own responsibility. During the Hackathon, it is the responsibility of each Participant to take all appropriate measures to protect his or her own data and/or software stored on his or her computer equipment against any attack. The responsibility of the Organiser and/or Partners may not be engaged in this respect. The Organizer shall not be held liable for contamination by possible viruses or intrusion by a third party in the system of the Participants’ equipment. The Organizer shall not be held liable for any damage caused to the Participants, their computer equipment and the data stored therein, as well as the consequences that may result from this on their personal or professional activity. The Participants remain solely responsible for their equipment and their Internet connection. The responsibility of the Organizer and / or Partner can not be held liable in particular in case of theft, loss and damage to the Participant’s equipment.

14. ACCEPTANCE OF THE HACKATHON RULES

The fact of registering and participating in the Hackathon implies the full and complete acceptance by the Participants, without any reservation, of these rules and its possible amendments in their entirety, which have the value of a contract.

15. MODIFICATION OF THE HACKATHON RULES

The Organizer reserves the right to modify the present rules at any time in the form of an amendment published by online announcement on the www.tamtam.com/events website. Any person refusing the amendment(s) will not be able to participate in the Hackathon. The rules are sent free of charge to all participants. The rules can also be consulted online at tamtam.com/events.

16. VALIDITY OF THE RULES

If one or more provisions of these rules and regulations should be annulled or declared ineffective, this shall not invalidate the whole of the rules and regulations or its other provisions and shall not affect the performance of the commitments undertaken by the parties hereunder.

17. APPLICABLE LAW AND CONFLICTS

The present regulation is subject exclusively to Togolese law. Any dispute arising during the Hackathon between the Organizer and/or the Partners and a Participant and which could not be settled amicably, will be submitted to the Court of First Instance of Lomé.
